The Magistrates of the Supreme Chamber, by majority vote, declared the appeal of cassation founded, establishing their decision in that the Ad Quem did not substantiate the reasons why the end of the de facto union was not in the year 2003, thus existing, lack of motivation in the sentence. Regarding the dissenting votes, the judges indicated that the sentence should not be reversed, since the objective of the cassation appeal is not to analyze the facts of the case, but rather to analyze the existence of a violation of constitutional regulations. In this work, the legal concept of de facto union was analyzed from a national perspective. Likewise, the essential elements for its constitution were analyzed, without leaving aside the analysis of when its death occurred and the property regime to which it adheres by virtue of different national jurisprudence. Finally, the analysis of the fundamental elements to consolidate the de facto union and the demise of the same regime was carried out. From the doctrine, jurisprudence and regulations consulted, it is concluded that this legal figure does not end due to a unilateral declaration of the parties involved, but rather, it ends due to the distancing and breaking of the sentimental bond of the cohabitants.
