The Inter-American Court of Human Rights ruling in the case of Inhabitants of La Oroya v. Peru, issued on November 27, 2023, marks a milestone in international human rights jurisprudence, specifically in the recognition and protection of the right to a healthy environment. Given that the affected community exhausted all legal avenues within the Peruvian legal framework due to the State's inaction in effectively countering the environmental damage, the controversy led to the case being brought before the Inter-American Court of Human Rights. This research aims to analyze the judgment from legal, social, and environmental perspectives, assessing whether the measures mandated by the Court were adequate to address the identified issues and examining how these measures should have been implemented to ensure the effective protection of human and environmental rights. Both national and international legal frameworks, alongside relevant jurisprudence, will be utilized to substantiate the analysis and propose concrete recommendations. As a proposal, this study advocates for the establishment of an independent environmental monitoring agency, detached from state influence, to effectively oversee the quality of air, water, and soil, with the objective of preventing future rights violations. Additionally, it recommends the implementation of advanced real-time monitoring technologies and regular external audits to timely identify and mitigate environmental risks. These measures, coupled with a system of clear sanctions for non-compliance, are intended not only to redress the harm suffered by the residents of La Oroya but also to prevent similar situations from arising elsewhere in the country. In conclusion, this work seeks to contribute to the strengthening of environmental regulations and the effective protection of fundamental rights in contexts of environmental degradation.
