The present work investigates Case No. 01301-2023-PA/TC, which presents the appeal of constitutional grievance resolved by the Constitutional Court. It develops an analysis of the right to the disability pension due to occupational disease and the new rules established by the magistrates to obtain it. The problem began with the amparo lawsuit filed by Mr. Over Nelson Paucara Sotomayor, who requested that his right to an occupational disease pension not be violated when he obtained a permanent partial disability due to pneumoconiosis according to the medical certificate issued by the Hospital II de Pasco of Essalud against the Oficina de Normalización Previsional, hereinafter ONP (Social Security Normalization Office). In the first instance, it was decided to declare the claim inadmissible since the Court considered that the medical certificate lost its probative value. Likewise, the Superior Chamber decided to confirm the first instance sentence for the same reasons. In this paper, we will develop the aforementioned case, explain the conceptual bases regarding the contract of mining workers, the occupational diseases they acquire as a result of their work in the mines, the requirements to obtain the pension benefit, and the substantial rules established by the present Constitutional Court to access the granting of life annuity for occupational disease.
