The objective of this work is to analyze the need, relevance and correspondence of the participation of the distribution of profits to the workers of the Single Union of Workers Pluspetrol Corporation S.A by a consortium of companies within the framework of Labor Appeal No. 01921- 2022 – LIMA, during the years corresponding to the year 2006 to 2012. In that sense, the appeal alleges: firstly, the regulatory violation of articles 5 and 8 of Legislative Decree No. 892, and; secondly, the non-application of article 2 of Supreme Decree No. 009-98-TR, regarding the requirements to be met by workers to obtain the right to participate in the profits generated by a company. There are four judges who state that the workers of the Pluspetrol Union do not meet the requirements to be beneficiaries of the payment of profits. However, we are faced with the existence of a singular vote which analyzes the reorganizations at the corporate level carried out by Pluspetrol before the distribution of profits and the lack of justification as to why these corporate tactics were established. Under such context, the extraordinary appeal of Labor Cassation No. 01921-2022 – LIMA has been legally analyzed; The concepts of: Right to Business Freedom, Right to payment of profits, Collective labor law, Fraud of the Law in Legal Entities and the Labor Process are addressed. Such concepts constitute the primary basis for the foundation and analysis of the appeal in question.
