The purpose of this research was to analyze the deceptive commercial practices that occur in consumer relationships. Although the supplier has greater knowledge than the consumer about the product and/or service it offers in the market based on information asymmetry, this does not imply that the supplier abuses this advantage to violate the rights of consumers and/or generate a negative impact through error in these. Therefore, in order to promote the proper functioning of the competitive process, the Technical Secretariat of the Unfair Competition Supervision Commission (hereinafter, the Secretariat), in the exercise of its functions, requested an ex officio investigation of some companies that They belong to the supermarket and department store sector, the same one that was in charge of the Economic Studies Management (hereinafter, “GEE”). In this investigation, the GEE verified that the company Conecta Retail S.A. (hereinafter, “Tiendas EFE”) set deceptive prices on its products, misleading consumers, since the advertising information was not transparent. In this context, in accordance with jurisprudence, current regulations and consultation doctrine, it was concluded that Tiendas EFE committed acts of unfair competition in the form of deception by disseminating a sales promotion other than the original one. Notwithstanding this, it's considered that unfair competition not only seeks to protect consumers, but also competing companies. This is in order to ensure the transparency and balance of the market in which economic agents and companies intervene.
