The profesional sufficiency word is base don the analysis of the Judgment issued by the Constitutional Court within the frameword of Case 02151-2018-PA/TC. This Case addresses a writ of amparo seeking protection of the right off access to electrical, due to the non-recognition of the granting o fan urban habilitation permit to access and enjoy the electrical energy service. Althought the majority of votes decided declare the lawsuit indamissible, and even the singular vote agrees with the criterion of the majority vote, disgreeing only on the grounds of inadmissibility. We respectfully dissent from the opinión of the Court, as unlike what is expressed in the singular vote, we consider that we are facing a cosntitutional right that is being directly affected by the State’s inaction. As an introduction, the concept of human dignity will be developed as an intrinsic value of the human being, as wel as being the foundation of economic, social, and cultural rights, both nationally and internationally. In this way, the right of access to electricity service – as a social right- involves much more than recognition, as it involves the development of other protected by the legal system. Then, the decision made bye the Constitutional Court willne analyzed, concluding that the protection action was suitable for protecting the right of access to electricity service. Finally in the absence of constitutional positivization, and in the face of the evident cumbersome and protracted procedures for the plaintiffs, this research proposes a series of suggestions to address this issue.
