The purpose of this professional work will be carried out by virtue of Ruling No. 00799-2022-PHC/TC issued by the Constitutional Court, in light of the criminal proceedings against Mr. Valverde Sal y Rosas for the alleged commission of crime of aggravated robbery, in which the transgression of the principle of procedural consistency was analyzed. Furthermore, through the TSP, it is intended to clarify whether or not it is possible for criminal judges to vary the criminal type, given that there is already a prior qualification carried out by the Public Ministry, since, as is the case of Mr. Valverde, who had been under investigation for the crime of aggravated robbery and during the oral trial the jurisdictional authority modified the type to aggravated reception, in accordance with Plenary Agreement No. 04-2007/CJ-116. In this order of ideas, we will carry out an exhaustive analysis of the case at hand, we will use various sources of information such as legislation, specifically the special rule in criminal and criminal procedure, the constitutional process as such, the criminal types subject to study and the possibility that there is a variation of a criminal type with a previous qualification related to the principle of procedural consistency. In conclusion, we consider that, if it is possible to vary the criminal type as long as the fundamental rights of the person under investigation are not affected; These being the right to defense, the right to contradiction and the right to due motivation of sentences.
