In this professional competency work, we will analyze the Judgment issued by the Constitutional Court in relation to the pronouncement made in Case No. 01217-2019-PA/TC, in which the constitutional grievance appeal is developed, through which the nullity of the resolution issued by the First Constitutional Chamber of the Superior Court of Justice of Lima is demanded. This resolution declared extramarital paternity and established the amount of child support to be fulfilled by the defendant. The Constitutional Court declared the appeal for constitutional protection UNFOUNDED; consequently, the defendant must comply with what is established in the resolution invoked in the appeal. In the voting, two judges issued grounds for their vote. The development of this work focuses on the lawsuit filed against the defendant, in which the judicial declaration of extramarital paternity of a minor was declared FOUNDED; as well as the payment of child support. The defendant appealed the judgment, but it was declared INADMISSIBLE. After exhausting the judicial process, he filed his appeal with the Constitutional Court, considering that the rights to effective judicial protection and due process were violated with this judgment. We will analyze the viability of presenting this appeal for constitutional protection. We have considered as sources for this analysis Law No. 29821, the Civil Code, the Political Constitution of Peru; as well as the statements of prominent authors in Family Law.
