In this paper, the existing conflict between the right to protest and freedom of movement is analyzed, based on the decision of the Constitutional Court in ruling 815/2021, related to Case No. 01749-2020-PHC/TC JUNÍN. This ruling arose from a habeas corpus process filed by the representative of Minera Volcan, seeking to end the blockade of the entrance and exit of the site where they conduct their economic activity, imposed by members of the San José de Andaychagua community. In this regard, the main arguments described in the ruling by the rapporteur, the reasoning of the vote, and the majority decision made up of individual votes will be presented. Furthermore, through the theoretical framework, the conceptual elements involved in the case evaluation will be developed. Additionally, the development in national and international law, jurisprudence, doctrine, international treaties, and comparative law of the concepts presented by the magistrates has been analyzed, due to the alleged violation of the right to freedom of movement during the exercise of the right to protest. Finally, we endorse the claim as unfounded, and based on the aforementioned, we offer a critical reflection on some arguments and the ruling issued by the Constitutional Court, as we consider the application of the Proportionality Test reasonable. Through this test, an adequate understanding of resolving future conflicts between constitutional rights would have been ensured.
