This paper will analyze Resolution 003285-2023-JUS/TTAIP, within the framework of the exercise of the right of access to public information, issued by the Court of Transparency and Access to Public Information (TTAIP) of the Ministry of Justice and Human Rights, which established a Precedent of Mandatory Observance on the criteria to grant access to a citizen to the information of the remunerations of the Judges of the Judiciary. The legal background of the TTAIP's Resolution will be analyzed, which ruled that the detail of the remunerations of the Magistrates is public except for the information related to the discounts, since it is information whose disclosure constitutes a violation of the personal and family privacy of the public servant. The scope and benefits in society of the right of access to public information and the right to privacy of public officials will be broken down in order to make a weighing of both rights limited to the information of the remunerations of the Magistrates. It is concluded that the right of access to public information on the remunerations of public officials should prevail over their right to privacy, in order to comply with the objective of promoting and ensuring democracy, institutionalism and the fight against corruption through the observance of the principles of transparency and publicity of information of public interest.
