Articles 3 and 18.2 of DL 1033 (LEGISLATIVE DECREE APPROVING THE LAW OF ORGANIZATION AND FUNCTIONS OF THE NATIONAL INSTITUTE FOR THE DEFENSE OF COMPETITION AND THE PROTECTION OF INTELLECTUAL PROPERTY) are norms that have established that the competence to know the processes with the INDECOPI is exclusive of the courts located in the city of Lima, this event generates in itself a barrier of access to justice and therefore an affectation to the right to Effective Jurisdictional Guardianship, since the citizen residing in different regions of the Peru must resort to formulating the lawsuits against INDECOPI to the city of Lima, which causes an additional cost for access to justice, since a person must move from the region where he lives to the city of Lima, assuming the cost that implies, in addition to the transfer is generated additional delay in its judicial process, and, finally, an unjustified advantage is granted to INDECOPI, that as part of the state it has all the advantages of litigating in any part of the country, especially in the places where it has a regional headquarters.
