Abstract: El objetivo general de la presente investigación fue, determinar las posibles afectaciones al
interés superior del menor en supuestos de maternidad subrogada, los objetivos específicos están
referidos a identificar y analizar la génesis y naturaleza jurídica del derecho a la procreación,
analizar cómo se viene tratando jurisprudencialmente los casos de maternidad subrogada en el
Perú, así como determinar los principios y normas que deben regir los procesos de reproducción
asistida en el Perú.
Se formuló como hipótesis general la siguiente: “Hay posibles afectaciones al interés
superior del menor en supuestos de maternidad subrogada y están relacionados con el derecho a
la identidad, dignidad y desarrollo integral.”
Dentro del marco teórico se analizó doctrina peruana e internacional, así como derecho
comparado que fundamentan el trabajo de investigación. La investigación fue cualitativa
documental, la discusión de resultados se realizó de acuerdo a dicho enfoque.
Las hipótesis fueron validadas y la principal conclusión arribada fue:
“Hay posibles afectaciones al interés superior del menor en los supuestos de maternidad
subrogada y están relacionadas con el derecho a la identidad a la dignidad y desarrollo integral
del menor”.
La recomendación fundamental está referida a considerar en el sistema jurídico peruano la
postura dominante sobre la aplicación de la maternidad subrogada, de igual manera se debe tener
en cuenta las implicancias jurídicas de aplicar está técnica.
The general objective of this investigation was to determine the possible effects on the best interests of the child in cases of surrogacy, the specific objectives are to identify and analyze the genesis and legal nature of the right to procreation, analyze how it is being treated jurisprudentially the cases of surrogacy in Peru, as well as determining the principles and norms that should govern the processes of assisted reproduction in Peru. The following was formulated as a general hypothesis: “There are possible effects on the best interests of the child in cases of surrogacy and are related to the right to identity, dignity and integral development.“ Within the theoretical framework, Peruvian and international doctrine as well as comparative law that underlie the research work were analyzed. The research was qualitative documentary; the discussion of results was carried out according to that approach. The hypotheses were validated and the main conclusion reached was: “There are possible effects on the best interests of the child in cases of surrogacy and are related to the right to identity and integral development of the child.“ The fundamental recommendation refers to considering in the Peruvian legal system the dominant position on the application of surrogacy, in the same way the legal implications of applying this technique must be taken into account.
