Conciliation is making its way as an alternative in conflict resolution, although there are currently aspects that must be examined in depth, in order to propose alternatives that improve the functioning of the conciliation system. The purpose of this investigation is to align Directive No. 001-2016-JUS/ DGDP-DCMA to the notion of availability of rights established by the Conciliation Law, so that certain civil claims that are currently being regulated as non-conciliable matters, this quality is recognized. The research approach is qualitative documentary, given that its analysis is based on legislation, jurisprudence and doctrine. Likewise, the type of legal research is propositional dogmatic, by raising valid reasons that justify a legislative proposal. The result of the study is the approach of a legislative proposal consisting of the modification of article 7 of the Conciliation Law, as well as the modification of Directive No. 001-2016-JUS/DGDP-DCMA approved by Directorial Resolution No. 069-2016 -JUS/DGDP. From the conclusions obtained, it is inferred that there are valid reasons that make a legislative proposal necessary to resolve the discrepancies between Directive No. 001-2016JUS/DGDP-DCMA and the Conciliation Law, on the determination of the conciliable nature of civil claims.
