Over the last few decades, there has been a significant increase in the amount of solid waste produced in metropolitan areas, which has caused problems with its management and an increase in the negative effects on human health and the environment. The Haquira landfill is located 30 minutes from the city of Cusco, on the border of the district of Ccorca and Santiago. This landfill has been receiving more than 400 tons of solid waste daily for approximately 15 years. Between 2012 and 2017, this landfill tried to be closed definitively, as it represents a serious threat to the health of the population of the area, as well as the violation of the right to enjoy a healthy and balanced environment, contemplated in Article 2, numeral 22 of the Political Constitution of Peru. The Specialized Environmental Oversight Agency (OEFA) determined that this dump is one of the five most dangerous in the country. The results of the investigation indicate that the Haquira landfill has a negative impact on the surrounding communities, violating the right to enjoy a healthy and balanced environment and other fundamental rights. Likewise, the definitive closure of the landfill, as well as the implementation of awareness policies for better environmental education and the promotion of a recycling culture to reduce the emission of solid waste, are necessary to avoid further violations of these rights.
