The present investigation focuses fundamentally on the need for Judicial Inspection as a mandatory requirement in a Domain Acquisition Prescription Process in the Judicial Branch and how this influences the Judge when resolving the aforementioned claim. Currently, in accordance with the provisions of article 505 of the Civil Procedure Code, it establishes a series of requirements that are special and that are necessary as a requirement of admissibility and procedure in the usucapion process, however, something that has been left aside is judicial inspection as a mandatory requirement and that in the same way the current procedural regulations must consider it. The judicial inspection, being optional, must be requested in a discretionary and dispositive manner by the plaintiff lawyer (as long as it is convenient) or, failing that, the Judge can incorporate it into the process as ex officio evidence, whenever he considers it appropriate. . On the contrary, since it is optional, it leaves expenses that cannot be requested and, failing that, the right of ownership can be declared fraudulently. With judicial inspection, it not only strengthens the credibility of the legal system by supporting judicial decisions with direct evidence, but also promotes equity by ensuring that the resolution of property acquisition claims is fair and based on the reality of the facts. In this context, judicial inspection emerges as an essential mechanism to achieve fair and transparent judicial results in the field of the acquisition of property rights.
