Abstract: El presente trabajo de Investigación de Tesis titulado “La Justicia Virtual y la
Afectación al Debido Proceso Penal” se genera a raíz del Covid-19 durante el año 2020 y
2021, el cual trajo consigo la aplicación de medios tecnológicos en la administración de
justicia, por lo tanto, se pretende analizar el uso o aplicación de las audiencias virtuales en la
tramitación de un proceso penal, si la misma afecta al debido proceso respecto a los
justiciables, o en todo caso genera algún beneficio. Así mismo el enfoque de la investigación
viene a ser cualitativo y dogmático, toda vez que se tratará de verificar la hipótesis planteada;
por otro lado, los resultados que sean obtenidos, podrán delimitar los beneficios o en su
defecto, alguna falencia respecto al uso y aplicación de la tecnológica en las audiencias
virtuales, si se llegó a afecta al debido proceso penal, así como a sus principios. Para terminar,
cabe preguntarnos si, en nuestro país, contamos con los medios tecnológicos suficientes y
sobre todo al alcance de toda la población, para así salvaguardar los derechos de las personas,
al realizar las audiencias en forma virtual.
In the present thesis research work entitled “Virtual Justice and the Affectation of Due Criminal Proccess” has as result of Covid -19 during the year 2020 and 2021, which brought with it the application of technological means in the administration of justice, and consequently, analysis is intented as an object regarding the use or application of virtual hearings to Criminal Due Process, focusing on the affectation that could be caused to due process with respect to the litigants, which leads to the objective of identifying if the heraring virtual brought some benefit or harm in the criminal process, Likewise, the research approach becomes qualitative and descriptive, since it seeks the description of data, On the other hand, the results that are obtained may define the benefits or failing that, some failure regarding the use and application of technology in virtual hearings and consenquently affecting due criminal process and its principles, Finally, it is worth asking ourselves if, in our country, we have sufficient technological means and, above all, within the reach of the entire population, in order to safeguard the rights o people, by holding hearings virtually.
