The objective of this thesis investigation is to publicize the development of non-compliance with Law No. 31298 "Law that prohibits public entities from hiring personnel through the modality of location of services for activities of a subordinate nature", in which, Make known the causes that lead to the persistence by the District Municipality of San Sebastián in hiring workers under this regime, compared to other contracting mechanisms, incurring in this way in the non-observance of the aforementioned law, while, they will demonstrate the consequences of non-compliance, despite the promulgation of the aforementioned law, through an exhaustive analysis of the norm, thus providing the reasons that drive the entities and specifically the aforementioned Municipality to continue working with service locators. In such a way that there is a correct interpretation, as well as a correct application of the norm, since it is important to prevail the labor rights of each person, being able to give access to the corresponding benefits, prioritizing equal treatment and non-discrimination.
