This scientific article addresses the general notions related to perpetual disqualification and mbezzlement as a result of corruption in Peru. The deficiency is evident when applying the penalty of perpetual disqualification for the crime of embezzlement committed against the public administration. Therefore, it was considered necessary to include an existing provision in the law to guarantee the correct application of this sanction, considering both Peruvian and comparative criminal law. The type of research used was technological, since it was based fundamentally on the incorporation of an article in the Peruvian criminal code, which allowed arguing the incorporation of the assumption of exceeding the appropriate value of ten tax units, in article 426 of the mentioned normative body, the positions argued by criminal lawyers and scholars in the matter were also considered. Indeed, the current regulations in Peru already establish the penalty of perpetual disqualification for officials or public servants. However, said regulation does not contemplate the most relevant assumption according to the present investigation. Therefore, the need to regulate this aspect is justified, since this makes it possible to effectively demonstrate the real impact on the protected legal asset, which is the State's patrimony. In addition, with its regulation, there would be no exceptions that would allow the defendant to rely on the rule that is most favorable to him, which would imply the application of the penalty of lifelong disqualification in a fair and adequate manner.
