A dignified burial in accordance with funeral rites is a fundamental right that springs from freedom of religion. As it is an essential right, which is, in turn, detached from human dignity, it deserves to be respected unrestrictedly, especially in times of humanitarian emergency. However, reality has shown us that, in the circumstances of a collective death caused by COVID-19, this right has been limited through generic measures that have been excessively restrictive for vulnerable groups such as indigenous peoples. These measures, which were established in sanitary protocols, protected people's health, but neglected the significance of the proper act of burial according to indigenous peoples' own funerary practices, thus obviating the need for an intercultural approach. In this regard, the aim of this research is to determine the legal criteria that the Peruvian state should follow when restricting the fundamental right of indigenous peoples to give burial to the deceased by COVID-19 according to their funerary rites, faced with the safeguarding of public health. The methodology used is analytical, applied to each variable of our problem, as well as the compilation of statistics, jurisprudence, and administrative provisions emitted in comparative and national regulations. As a result of the research, we found that it is necessary to implement legal criteria in line with internationally recognized constitutional principles, in order to apply them to the state measures established by our government.
