The research article titled “Legislative proposal to incorporate the transfer and concealmentof assets as an aggravating factor in the crime of omission of family assistance”, whose objective is to propose the incorporation of the transfer and concealment of assets as an aggravating factor in the crime of omission of family assistance. family, in protection of theprinciple of best interests of the child and adolescent. To achieve this general objective, twospecific objectives are proposed; The first is to exhaustively analyze the crime of omissionof family assistance in national and foreign law, emphasizing similarities and differences; the second, to study the best interest of the minor and the serious impact on the realization of the right to food when the obligor does not have assets. Regarding the methodological framework, it is a qualitative research, in which the documentary analysis technique is used.The results verify the need for the Peruvian legal system to regulate the transfer of assets or resignation from work as aggravating factors of the crime of omission of family assistance;situation that is already being regulated in Honduras, Panama and Argentina. Finally, it is concluded that the incorporation in question would strengthen the protection of the rights of minors, guaranteeing that the maintenance obligation is complied with and classifying conduct that is detrimental to the development of minors as passive subjects of the crime inquestion.
