In Latin America, a first legal meaning of the term typicity and objective imputation is defined as a limit to ius puniendi. The general objective is to determine the relationship between objective imputation in prosecutorial accusations and the right of defense at the Public Prosecutor's Office, Tarapoto-2020. It corresponds to a basic research of non-experimental design, the population consisted of 80 fiscal accusations and interviews with magistrates. The research techniques were the analysis of documentary records and interviews with experts using a document analysis guide and a guide of questions. Based on the results, it is pointed out that the guidelines of the objective imputation are framed in the crimes of result that is related to the not allowed danger; likewise it obeys to the crimes of danger within the theory of causality. It is concluded that the Pearson Chi-square test (X2=80.00) is significant, because it is widely higher than the tabular Chi with 1 degree of freedom (3.8415), with a bilateral sig. (0.00 < 0.05); according to the decision rule, Ha is accepted, where there is a significant influence of the objective accusation in the prosecutorial accusations and the right of defense in the Public Prosecutor's Office.
