The decision of a judge to suspend the execution of custodial sentences, as an alternative to effective imprisonment, especially in crimes whose sentences do not exceed four years, has become a controversial issue in criminal doctrine. Usually it is taken into consideration that whoever committed the crime did it for the first time and the probability of committing a new crime of similar characteristics is very low, given its limited dangerousness. The research problem is: What is the relationship between the suspended custodial sentence and recidivism in the crime of theft at the First Unipersonal Criminal Court of Tarapoto, 2017-2019? The general objective is: To determine the relationship between the custodial sentence of suspended execution and recidivism in the crime of theft, in the First unipersonal criminal court of Tarapoto, of 2017-2019 and specific objectives: (1) To describe the custodial sentence of suspended execution in the First unipersonal criminal court of Tarapoto, of 2017-2019 (2) To describe recidivism in the crime of theft, in the First unipersonal criminal court of Tarapoto, of 2017-2019. The study design is a quantitative research with a descriptive correlational design; likewise, it is concluded that when describing the custodial sentence of suspended execution in the First Unipersonal Criminal Court of Tarapoto, 60% is divided into explicit justification and 40% into justification of mitigating factors.
