The aim of the present research is to determine how the right to communal property recognized in Convention 169 of the International Labor Organization (ILO) is being violated in the native communities of the district of Chazuta, province and region of San Martín. Its study, analysis and development, was carried out under a quantitative approach, of a basic type, at a simple descriptive level, of a non-experimental design; The study sample was made up of 15 community members from each native community (Mushukllacta of Chipaota, Shilcayo, Canayo and Llucanayacu), making a total of 60, to whom a questionnaire was addressed, which was elaborated through open questions, taking into consideration the indicators and dimensions of the studied variables, all with the purpose of understanding the perceptions, opinions or attributes of the elements or factors that make up the research. The results showed that the communal property rights in the native communities of the Chazuta district have been constantly violated by the lack of delimitation, demarcation and ownership of their lands and by the processes of occupation through the concessions granted by the state itself.
