The research entitled;The due motivation of circumstantial evidence in the crime of simple collusion in relation to Nullity Appeal No. 1912-2005 - Piura;, had the objective of analyzing how circumstantial evidence should be motivated in the crime of simple collusion in relation to Nullity Appeal No. 1912-2005-Piura. Evidence is essential to be able to determine the commission of a criminal act; therefore, the study of evidence by indications, defined as the intellectual perception made by the judge, which is based on a fact. The methodology was basic and based on grounded theories; the instruments used were the documentary analysis guide and the expert interview guide. The main result indicated that the circumstantial evidence takes facts occurred in reality being duly verified, called as known facts and on the base, by means of a logical inference, it establishes the responsibility of the defendant in the criminal act. It is concluded that the motivation of the circumstantial evidence in the crime of simple collusion under the Nullity Action No. 1912- 2005-Piura is structured under the precepts that not just any evidence is sufficient to support a conviction, but those that comply with the material requirements of validity of the same.
