The present research aimed to determine the reasons why establishing shared custody as a general rule would cause harm to addressing gender-based violence within the context of family relationships. The general hypothesis posited that the reasons for the detrimental impact of establishing shared custody as a general rule on addressing gender-based violence in family relationships include the lack of protection for victims in situations of gender-based violence, disincentives to report, and the loss of autonomy for women victims. The research followed a qualitative approach, utilizing document analysis of doctrine, jurisprudence, legal norms, comparative law, and expert interviews as the data collection technique. The hypotheses were validated, leading to the primary conclusion that establishing shared custody as a general rule could result in significant drawbacks in addressing gender-based violence within family relationships. This approach may lead to the lack of protection for victims, discourage reporting of abusive situations, and contribute to the loss of autonomy for affected women. It is crucial to consider alternatives that prioritize the safety and well-being of victims, promoting a system that adapts to the specificities of each case and ensures the protection of those in vulnerable situations. The most important recommendation is to support a more flexible and personalized approach in determining custody in cases of gender-based violence. This entails carefully considering the specific circumstances of each situation and the need to safeguard the safety and well-being of victims. The implementation of policies that encourage safe reporting, provide effective protection to victims, and respect their autonomy in decision-making regarding child custody is crucial. Additionally, strengthening support and counseling systems for victims is suggested to empower them and facilitate informed decision-making.
