This work focuses on analyzing the violation of the right to equality, specifically regarding the origin of the cause in first and second instance processes, which do not delve into the implications of the employment relationship or its termination. Consequently, the right to equality is violated, as per the Plenary Judgment 440/2023 of the Constitutional Court, arising from the amparo complaint, by prioritizing fundamental rights over the reality of factual circumstances. In the first chapter, the facts of the case, the requests made, the arguments of the parties, and the analysis of the Constitutional Court are summarized. Relevant foundations regarding the infringement of the right to equality, the right to a reasoned resolution, and the right to work are examined; raising the question to be developed in the second chapter: should the violation of the right to notification take precedence over the primacy of the reality of a case? In the second chapter, the conceptual foundations related to the right to fundamental rights, the right to notification, the impact on the right to equality, and the protective nature of the law are discussed, addressing the issue raised in chapter one. Finally, in the third chapter, the group's stance is presented, emphasizing our opinion on which right should prevail, considering legal guidelines, the primacy of reality, and fundamental rights, while questioning the lack of rigorous interpretation and the insufficiency to resolve issues. Therefore, measures are proposed to strengthen the application of objective criteria and promote a responsible and objective analysis that goes beyond articulating responses to legal grounds, instead fostering resolutions aimed at strengthening the judicial structure and the critical analysis of supreme judges.
