In this work, we will analyze the mandatory precedent contained in Resolution No. 186-2021 / CCD-INDECOPI dated October 5, 2021, of File No. 281-2020 / CCD, which has as its legal problem the analysis of the conduct of suppliers regarding those misleading advertisements that are carried out in the consumer market. Specifically, according to this precedent, it is analyzed whether the conduct of Conecta Retail S.A. known as Tiendas EFE would have carried out acts of deception, according to article 8 of Legislative Decree No. 1044, Law to Repress Unfair Competition, since it promoted the sale of a television indicating an alleged reduction in its price from S/ 899 soles to S/ 699 soles, misleading consumers, creating a false perception of savings in them. To this end, the analysis will be established based on international standards that will allow the establishment of parameters or criteria for the mandatory precedent of compliance with misleading advertising. Likewise, the Economic Studies Department, when preparing a technical report on the matter, was able to establish that, for the existence of a true promotion, it must be verified whether the reference price was maintained for a longer period of time than the promotional price. Thus, visits were made to stores, including the offending supplier, verifying that said promotion was concealed in a deception because the price was raised to achieve the sale of the product quickly, affecting the interests and expectations of consumers in the market.
