ABSTRACT This -thesis-is based on the study of the elements of human trafficking crime, as they are described in the Protocol to Prevent, Suppress-and-Punish-Trafficking in Persons especially Women and Children; in order to determine to what-extent, it is possible to-affirm-that the consent granted by the victim of legal age for the crime of trafficking in persons is a valid ground for exclusion from criminal responsibility. For this purpose, different materials were analyzed, both doctrinal and jurisprudential, the same that were studied from a comparative perspective and under a Human Rights approach, having used for it techniques of data and document collection,signing, and normative interpretation, in order-to determine-the existence of dogmatic bases to support a possible situation of non-punishable in the crime of trafficking in persons. In this way, we arrived at conclusions-that validated-our-hypothesis, and -corroborated-our objectives. Thus, the application of the consent ranted by the victim of legal age in the crime of trafficking in persons as a cause for exclusion of criminal responsibility is not consistent with the character of an unavailable legal right of human dignity or dignity, nor with the seriousness of the crime of trafficking in persons, the same that, according to the international treatment it receives, can be considered a crime against humanity. Finally,-it was-decided to recommend a normative modification, in order to exclude the legal effects of consent granted by the victim in the crime of human trafficking.
