ABSTRACT This research work entitled: "Prevalence of Dynamic Identity against DNA Testing in Paternity Challenge Processes", arises in response to the constant changes produced in society, which are ighlighted in the behaviors and aptitudes of human beings, family relationships not being alien to it, consequently, the Law must be in accordance with the evolution of the same for a correct regulation. This is how our interest was born to investigate the judicial pronouncements on the challenge of paternity, having as its main objective to analyze and identify if as the years have passed there has been a variation in the criteria used by the magistrates at the time of sentencing said processes, finding that the majority of judges have chosen to give prevalence to the dynamic identity in front of the scientific DNA test, demonstrating a significant change in the way of solving the paternity challenge processes during the last years. Based on the doctrinal and jurisprudential source, we have concluded that it is necessary to assess both dimensions of the right to identity and it is recommended that the magistrates specializing in Family Law can unify their criteria by establishing assumptions to take into account of according to each specific case, in accordance with the Principle of Higher Interest of the Child.
