Abstract: La presente tesis tuvo como objetivo general determinar que el sindrome de alienación
parental debe ser causal de variación de tenencia, en el sentido que vulnera el interés superior
del niño. Para tal efecto se precisa que la metodología de investigación aplicada es de tipo
descriptivo, enfoque cuantitativo, con un diseño no experimental -transversal, con una
muestra no probabilística de 25 personas. Se contó con la encuesta como técnica de
recolección de información, utilizando como instrumento el cuestionario. Los resultados
muestran que el síndrome de alienación parental tiene que ser motivo de cambio de tenencia
en el extremo que vulneran los derechos del niño; siendo que la Constitución Política dispone
que el Estado debe proteger al menor que se encuentra abandonado. Concluyendo así, que
el sindrome de alienación parental se expresa en conductas que dificultan la relación paterno
o materno filial, por lo que premedita ser causal de variación de tenencia, en el sentido que
vulnera el interés superior del niño.
The general objective of this thesis was to determine that the parental alienation syndrome should be a cause of variation in possession, in the sense that it violates the best interests of the child. For this purpose, it is specified that the research methodology applied is of a quantitative descriptive type, with a non-experimental-cross-sectional design, with a nonprobabilistic sample of 25 people. The survey was used as an information collection technique, using the questionnaire as an instrument. The results show that the parental alienation syndrome has to be a reason for change of ownership to the extent that it violates the rights of the child; being that the Political Constitution provides that the State must protect minors who are abandoned. Thus concluding, that the parental alienation syndrome is expressed in behaviors that hinder the paternal or maternal filial relationship, which is why it is intended to be a cause of variation in possession, in the sense that it violates the best interests of the child.
