ABSTRACT Surrogacy is an assisted human reproduction technique that has generated much controversy at the national and international level; however, it is the solution for many people who want to conceive a child and cannot do so physiologically. In the present research work we propose as main objective to determine if the conventional legitimacy of Surrogacy in protection of the right to procreation affects the preponderant jurisdictional determination of socio-affective affiliation as an expression of the right to dynamic identity in respect of the best interests of the minor. The importance of an analytical and rigorous study of the problems around Surrogacy allows to duly determine the affiliation of the minor in favor of the one who expressed his procreational will and the projection of it in an environment that optimizes the best interests of the conceived. The law is evolving and Peru has not been oblivious to new technologies in biomedicine, therefore, the legitimacy of Assisted Human Reproduction Techniques must be recognized as a result of the conventional doctrine dictated by International Human Rights Law. This thesis report is novel because, from a conventionalized constitutional approach, the predominant criteria in national judicial processes are analyzed for the purpose of recognizing the minor's affiliation with the intended parents in the framework of Surrogacy.
