ABSTRACT The basis of this investigation is the social problem of discrimination and stigmatization suffered by transsexual population, who have to initiate a judicial process to achieve registry rectification about name and sex. So, the main objective of this investigation is establish if judicial process, specifically the summary process allows to guarantee and recognize the right to gender identity of the transsexual population, the same that is materialized through the registry rectification of the name, sex and image data in the national identity document. To do this, we have proceeded with the collection of information from the doctrine, jurisprudence and national and foreign legislation on issues related to rights that are related to gender identity and the procedure and requirements established to proceed with the change of name and sex of transsexual people, both nationally and internationally. This procedure for obtaining data has become an objective analysis of the information collected, from which it has been obtained as a main result that the judicial process is not the ideal way to claim recognition of the gender identity of transsexuals, because in the judicial process a series of factors have been identified that have a negative impact on the adequate recognition and guarantee of the right in question. Thus, it has been concluded that it is necessary to establish a specific procedural route for the registry rectification of the data on the name, sex and image of transsexual people, which responds in a minimal way to the international standards to which the Peruvian state must respect.
