ABSTRACT This research thesis was carried out with the general objective of “Analyzing if the Best Interest of the child is applied through the normative body of Law N ° 30311 that allows the adoption by couples that make up a de facto union, Trujillo, 2019”, with The purpose of accounting for the impact of the aforementioned law on the reality of the abandoned child waiting for a home. The principle of the best interests of the child is applied relatively, in the adoption by couples that make up a de facto union, allowing that more couples that maintain a harmonious, continuous and stable relationship can be qualified as suitable to adopt, prioritizing the best interests of the child, such as the right to have a family, complying with and following due process to access it. However, it is necessary to mention that there is discriminatory treatment in terms of compliance with the requirements of the adoption regulations, since in the course of its application, de facto unions encounter an obstacle to becoming adopters due to the enforceability of a family income. Likewise, the MIMP must take the initiative to implement a solution to this economic challenge, exceptionally granting a bonus or financial subsidy for those couples who, having met the other requirements to adopt, do not have the required income.
