ABSTRACT The advancement of technology and the need to reduce the time committed to daily tasks, has brought the emergence of digital platforms that offer the provision of a variety of services, including the home delivery service, which for their convenience and economy, are very attractive for consumers, also generating new options so that a greater number of people can generate income. Since 2021, after acquiring the shares of the company Glovo, PedidosYa offers the delivery service through digital platforms in our country, affirming that they are self-employed workers, who perform self-employment within the framework of an economic model of platforms. The present research aims to ecognize whether the form of provision of services of the couriers affiliated to the digital platform PedidosYa, there are indications of labor that distort the civil contractual relationship of lease of services contained in their contracts, evidencing labor fraud. The conclusions of the investigation are of special interest in evidencing the true legal qualification that corresponds to the contractual relationship between the affiliated couriers and the digital platform PedidosYa, after subsuming them in the indications of labor exposed in the jurisprudence and national and international doctrine, as well as evaluating whether it is viable to adapt international standards to our country.
