This professional sufficiency work addresses an analysis of the legal prohibition on the secured creditor, and its controversial application to its representatives, to carry out the extrajudicial sale of the asset affected by chattel collateral, in accordance with the legal framework on chattel collateral. To this end, it is considered that the representation of the execution of the chattel collateral, through extrajudicial sale and/or award of the asset, must fall to a third party outside the parties of the legal relationship, since the purpose of the regulations applicable to the legal prohibition is to avoid any conflict of interest that may arise due to the creditor. In this context, Resolution No. 709-2022-SUNARP-TR will be analyzed, considering the vote in favor and in discord on the final decision that deals with the present controversy regarding the legal prohibition applied to the representatives of the secured creditor, contained in the applicable chattel collateral law. Therefore, this work seeks to adopt a position on the debate of Resolution No. 709-2022-SUNARP-TR to promote a better understanding of the scope of application of the law, specifically on the legal prohibition and the designation of the representative, through a doctrinal and normative analysis in civil, registry and property rights matters.
