The present investigation was based on the problem: Does literal a, paragraph 2 of article 386 of the Civil Procedural Code on the pretension of the appeal in cassation become unconstitutional because it conditions that for the appeal in cassation to proceed it needs to be greater than 500 Procedural Reference Units or inestimable in money? The main objective was: To determine whether paragraph a, subsection 2 of article 386 of the Code of Civil Procedure on the claim of the appeal in cassation becomes unconstitutional by conditioning that for the appeal in cassation to proceed it needs to be greater than 500 Procedural Reference Units or inestimable in money. The technique used was the survey and the instrument was the questionnaire. The population consisted of the trial lawyers of the Loreto Bar Association; the sample consisted of 59 lawyers of the Loreto Bar Association. The design used in this research is the "non-experimental transactional or transversal type of descriptive level". For the statistical analysis, descriptive statistics were used to study the variables independently and to demonstrate the hypotheses, the parametric chi-square test (x2) was used. The results indicated that: Subparagraph a, paragraph 2 of article 386 of the Code of Civil Procedure on the pretension of the appeal in cassation becomes unconstitutional because it conditions that for the appeal in cassation to proceed it needs to be greater than 500 Procedural Reference Units or inestimable in money.
