The present investigation started from the problem: Analyze what is the degree of violation of the right to due motivation of judicial sentences in cases of eviction due to precarious occupation - Cassation 783-2017 - Huánuco? With the objective: To determine the degree of violation of the right to due motivation in judicial decisions of eviction cases due to precarious occupation, using Cassation No. 783-2017 - Huánuco as an example, in order to identify and understand the deficiencies in the foundation and application of the pertinent legal norms. The technique used was documentary analysis of similar cases. The population was made up of all the Cassatory Judgments of the Supreme Court of the Republic in matters of civil procedural law of the year 2017. The design that was used was non-experimental of a correlational transactional type. Descriptive statistics will be used for the statistical analysis, for the study of the variables independently and for the demonstration of the hypothesis this will be done through the specialized bibliography used. The results indicated that: In the eviction process for a precarious occupant, it was determined that the right to restitution of possession is discussed, but not who has the right to property, therefore, constitutionally protected rights are being violated, such as: Right to due process and motivation of judicial decisions.
