The present investigation started from the problem: Is it possible that family judges within their judicial powers can apply the dynamic burden of proof in family proceedings? And the objective was: Explain whether family judges within their judicial powers can apply the dynamic burden of proof in family proceedings. The technique used was the survey and the instrument was the questionnaire. The population consisted of 80 trial lawyers. The design that was used was the non-experimental of the correlational type. For the statistical analysis, descriptive statistics were used, for the study of the variables independently and for the demonstration of the hypotheses, the non-parametric chi-square (x2) inferential statistic was used. If it is possible that family judges can apply the dynamic burden of proof, this is due to the fact that there are enough regulations that make family processes more flexible.
