Our legal system and especially our Political Constitution, protect citizens from any abuse by the authority, institution or other similar entity that intends to commit an infraction against the administration and vice versa. Likewise, the state guarantees that its economic and human resources are used in the most optimal way possible without their use causing economic or property damage, etc. Along these lines, we can state that the Administrative Sanctioning Procedure is that mechanism or set of actions determined to sanction and/or determine administrative responsibility of that official or employee of the different institutions of the State. These sanctioning acts seek to protect the state from the alleged acts of corruption entrenched in our public institutions, but it is important that these corrective and sanctioning actions respect the bruising principles of administrative law and its related laws. Thus, these acts have become a persecutor of officials and employees without often respecting their fundamental rights such as the right to defense, due procedure, etc. With this research study, we want to contribute to understanding that what has been done wrong or what is being done wrong can be sanctioned and corrected without violating the Constitution and the rules established in each sanctioning procedure.
