Vulnerabilidad del debido procedimiento administrativo en aplicación del decreto legislativo n° 1318, en la escuela de educación superior técnico profesional policial – Iquitos – 2020 - 2021

Abstract

La presente investigación se ha realizado en la EFPP-Iquitos que ha venido formando policías al servicio de la sociedad; y, que en sus etapas de formación profesional policial han sido sujetos de diferentes procedimientos administrativos disciplinarios por infracciones al reglamento de régimen disciplinario vigente en sus procesos de formación y que a lo largo de la historia se han ido modificando por las constantes violaciones y vulneraciones al mandato de la normatividad. Las personas bajo control administrativo gozan de los potestades y aval que surgen de la garantía procesal administrativa y por tanto tienen derecho a recibir una sanción motivada con base en ley, emitida por quien es competente para ello y en el periodo que se ajuste a la normativa legal vigente; y apelar a aquellas que los afecten. En esta investigación se demuestra que los alumnos en su condición de Estudiantes PNP no han sido respetados sus derechos y muchas veces sancionados de manera arbitraria en sede administrativa y restituidos sus derechos en sede judicial ante la inminente y manifiesta vulneración a las garantías procedimentales.
