The present investigation departed from the problem. Article 829 of the Civil Code regarding the concurrence of double and single-sink brothers becomes unconstitutional when he points out "in the cases of concurrence of father and mother brothers with half brothers, those will receive double portion that these" Loreto, 2021? And the objective was: to determine whether Article 829 of the Civil Code regarding the concurrence of double and simply bond brothers becomes unconstitutional when it points out "in the cases of concurrence of father and mother brothers with half brothers, those will receive double portion that these" Loreto, 2021. The technique used was the survey and the instrument was the questionnaire. The population was formed by 100 Litigative Attorneys from the Province of Maynas, the sample was formed by 80 litigating lawyers. The design that was used in the present investigation is the "non-experimental of transactional type". For the statistical analysis, the descriptive statistics was used, for the study of the variables independently and for the hypothesis demonstration, the Chile square Parametric (X2) was used. The results indicated that: Yes 829 Article 829 of the Civil Code becomes unconstitutional concerning the concurrence of double and simple bond brothers, since it goes against Article 2, subsection 2 of the political constitution of Peru, as soon as it indicates the equality before the law. Having determined the above, we can then indicate that it would be feasible to modify the paragraph 8 of the 802-civil code in the extreme of establishing the equal of portion between the collateral relatives.
