Relación del derecho a la igualdad y la no discriminación, con la imposibilidad del matrimonio homosexual en el Perú, a la luz del derecho comparado

Abstract

La investigación contempla el estudio respecto de la vulneración de los derechos a la igualdad y la no discriminación a la luz del derecho comparado en el matrimonio homosexual en el Perú, para el cual se plantea el siguiente interrogante ¿Cómo se relaciona el derecho a la igualdad y la no discriminación, con la imposibilidad del matrimonio homosexual en el Perú, a la luz del derecho comparado?, teniendo como objetivos general Determinar la relación el derecho a la igualdad y la no discriminación, con la imposibilidad del matrimonio homosexual en el Perú, a la luz del derecho comparado. Plantea una metodología de enfoque cuantitativo de tipo básica con un diseño no experimental, empleando la técnica de encuesta para la recolección de datos. Los resultados de la investigación arrojan la existencia de impedimentos para la regulación del matrimonio igualitario, basados en factores normativos, factores religiosos, factores sociales y factores bilógicos, siendo empleados por los operadores jurídicos en los fallos de casos que buscan el reconocimiento de este matrimonio dentro del territorio. Asimismo, se evidencia que el Perú viene siendo un país que aun se resiste a legislar jurídicamente el matrimonio igualitario en su normativa, a diferencia de otros países latinoamericano y europeos que ya reconocen esta figura, en respeto del derecho a la igualdad y de no discriminación de las personas homosexuales. Obtenido como conclusión que la relación del Derecho a la igualdad y no discriminación y Matrimonio homosexual en el Perú, es significativa alta, lo cual significa la existencia de la vulneración del derecho de igualdad y no discriminación ante la imposibilidad del matrimonio homosexual en el Perú.

The research contemplates the study regarding the violation of the rights to equality and non-discrimination in light of comparative law in homosexual marriage in Peru, for which the following question is raised: How is the right to equality related and non-discrimination, with the impossibility of homosexual marriage in Peru, in light of comparative law?, having as general objectives: Determine the relationship between the right to equality and non-discrimination, with the impossibility of homosexual marriage in Peru, in the light of comparative law. It proposes a basic quantitative approach methodology with a non-experimental design, using the survey technique for data collection. The results of the research show the existence of impediments to the regulation of equal marriage, based on normative factors, religious factors, social factors and biological factors, being used by legal operators in the rulings of cases that seek the recognition of this marriage within Of the territory. Likewise, it is evident that Peru has been a country that still resists legally legislating equal marriage in its regulations, unlike other Latin American and European countries that already recognize this figure, in respect of the right to equality and non-discrimination. of homosexual people. The conclusion is that the relationship between the Right to equality and nondiscrimination and homosexual marriage in Peru is significantly high, which means the existence of a violation of the right to equality and non-discrimination due to the impossibility of homosexual marriage in Peru.
