Abstract: En el ámbito jurídico, el control constitucional ha sido uno de los temas que
más se ha desarrollado. Esto se debe a que el Estado Constitucional de derecho
surge con la vigencia del principio de supremacía constitucional, acompañado por
los principios de jerarquía normativa e inviolabilidad de la Constitución. Como es
sabido, una de las formas de asegurar la vigencia y el respeto de la Constitución es
el control concentrado, a cargo de un órgano especializado. Cuando este órgano
declara la inconstitucionalidad de una norma, esta es expulsada del ordenamiento
jurídico. Asimismo, el modelo de control difuso permite a los órganos
jurisdiccionales inaplicar una norma cuando esta es contraria al ordenamiento
jurídico. En el Perú, coexisten ambas formas de control constitucional: el
concentrado, a cargo del Tribunal Constitucional, y el difuso, que aplican los
jueces. No obstante, la problemática se centra en el control difuso en sede
administrativa. Aunque el Tribunal Constitucional había reconocido que este
control podía ejercerse, cambió su postura y apuntó que no es posible, pese a que a
nivel internacional se ha indicado que sí es posible.
En ese sentido, la investigación se ha realizado en función de la necesidad
de restablecer el control difuso en los tribunales administrativos del Perú,
basándose en la decisión adoptada por la Corte Interamericana de Derechos
Humanos. A partir de ello, y con el desarrollo de la doctrina y la jurisprudencia,
sobre todo a nivel internacional, se ha logrado acreditar que es necesario
restablecer el control difuso en los tribunales administrativos del Perú.
