Reconocimiento a la doble filiación materna para hijos de familias homoparentales en la legislación peruana - 2024

Abstract

El objetivo del estudio fue determinar qué derechos se ven potencialmente afectados por la falta de reconocimiento e inscripción de la doble filiación materna para hijos de madres del mismo sexo. Fue de enfoque cualitativo, diseño fenomenológico donde participaron cuatro familias homoparentales conformadas por madres lesbianas casadas o en unión civil (con registro en otro país donde es legal el matrimonio igualitario y/o unión civil) con más de dos años de convivencia que son madres o que están pensando serlo; también, participaron seis expertos abogados en materia de familia, constitucional y civil. Se aplicó una guía de entrevista semiestructurada y en nuestros resultados las participantes afirman que la homosexualidad es asociada a la discriminación, afectando la naturalidad de la maternidad lésbica y su reconocimiento como tal; por ello, indicaron que las familias homoparentales deberían estar protegidas jurídicamente y se debe incluir artículos en la legislación que conceda y reconozca la maternidad lésbica. Asimismo, indicaron que la falta de reconocimiento de hijos de familias homoparentales en Perú afecta el derecho a la identidad, el derecho al nombre y el interés superior del niño y que el estado debe realizar su rol protector con los menores de edad.

The objective of the study was to determine which rights are potentially affected by the lack of recognition and registration of dual maternal filiation for children of same-sex mothers. It had a qualitative approach, phenomenological design with the participation of four homoparental families formed by lesbian mothers married or in civil union (with registration in another country where equal marriage and/or civil union is legal) with more than two years of cohabitation who are mothers or who are thinking of becoming mothers; also, six expert lawyers in family, constitutional and civil matters participated in the study. A semi-structured interview guide was applied and in our results the participants affirm that homosexuality is associated with discrimination, affecting the naturalness of lesbian motherhood and its recognition as such; therefore, they indicated that homoparental families should be legally protected and articles should be included in the legislation that grant and recognize lesbian motherhood. They also indicated that the lack of recognition of children of same-sex parent families in Peru affects the right to identity, the right to a name and the best interest of the child and that the state should play its protective role with minors.
