The objective of the study was to determine which rights are potentially affected by the lack of recognition and registration of dual maternal filiation for children of same-sex mothers. It had a qualitative approach, phenomenological design with the participation of four homoparental families formed by lesbian mothers married or in civil union (with registration in another country where equal marriage and/or civil union is legal) with more than two years of cohabitation who are mothers or who are thinking of becoming mothers; also, six expert lawyers in family, constitutional and civil matters participated in the study. A semi-structured interview guide was applied and in our results the participants affirm that homosexuality is associated with discrimination, affecting the naturalness of lesbian motherhood and its recognition as such; therefore, they indicated that homoparental families should be legally protected and articles should be included in the legislation that grant and recognize lesbian motherhood. They also indicated that the lack of recognition of children of same-sex parent families in Peru affects the right to identity, the right to a name and the best interest of the child and that the state should play its protective role with minors.
