This professional proficiency work aimed to analyze the tax impact of transfer pricing at the company EMIN in Peru during the year 2023. The methodology used included semi-structured interviews with transfer pricing experts, as well as a non-experimental qualitative approach. The results of the interviews revealed three main alternatives to mitigate tax non-compliance: hiring a tax-specialized accountant, contracting an external consulting firm, or implementing an ERP system to automate transfer pricing management. Each alternative presents advantages and disadvantages in terms of costs and internal control, with hiring a specialized accountant being the option most aligned with EMIN’s needs. In conclusion, the tax impact of the situation is mainly reflected in the underestimation of accrued interest on a loan to a related party, which led to a tax adjustment of S/ 35,525.00 and an additional tax of S/ 10,479.88. Additionally, the failure to submit the Transfer Pricing Technical Study could result in a severe fine of up to S/ 89,262.13 by 2023; however, thanks to the proposed solution, this can be reduced by up to 80% by opting for a gradual penalty reduction regime. This highlights the importance of complying with transfer pricing regulations to avoid penalties and optimize tax planning. A more direct control over the company’s regulatory compliance and tax management is recommended.
