The development of technology has disrupted the digital economy, which is why it is common for businesses to carry out in the virtual world, as the use of cryptoassets as investment instruments. In this context, lately we have seen people and companies decide to tokenize digital representations of assets (NFTs) on the Blockchain for the purpose of trading them in the digital world, generating large profits. In this sense, since it is a reality that operations with NFTs are carried out in Peru; In this research, it will be analyzed if according to the Peruvian Income Tax Law, the sale of NFTs, which digitally represent shares of a Peruvian company, which only asset is a real estate located in Peru, would be taxed, taking in consideration that the underlying asset of these NFTs are the expected economic rights of the earnings of the Peruvian company. Accordingly, under our current tax legislative, the sale of NFTs does not generate income from a Peruvian source for the non-resident shareholders of the Peruvian company; therefore, the profit generated by said sale cannot be subject to income tax, since we are dealing with the sale of a digital representation, not of the underlying asset, being the operation carried out on the Internet.
