Since the beginning, we have wondered about the multiple animal species that cohabit with us, and we have established multiple relationships with them. We have used and domesticated them to feed ourselves, clothe ourselves, explain our reality, an entertain ourselves. Many of these practices are constantly being questioned, with one of the main targets being cultural traditions. In this context, bullfighting is one of the most discussed topics. Laws protect or ban it, high courts pronounce to evaluate its legitimacy, and citizens protest. Peru is not exempt from this debate, as its regulation has shielded bullfighting. This has led the Constitutional Court to pronounce on three occasions with diverse results. The purpose of this thesis is to analyze the constitutionality of bullfighting in Peru from an abolitionist perspective. First, we review the theoretical aspects regarding moral and legal considerations towards animals as a method of analysis. Additionally, we conduct a comparative study of legislation and jurisprudence in animal law and bullfighting. Finally, we develop an analysis of a hypothetical case on the constitutionality of the prohibition of bullfighting from an abolitionist approach.
