In Peru, the right to freedom of transit is recognized by the Political Constitution in its article 2, paragraph 11, being the attribute ius movendi et ambulandi, the one which consists in the right of all Peruvians or foreigners with legal residence in this country to move freely and without prohibitions through national territory, as well as to leave and enter it, except for limitations and/or restrictions that may occur for different reasons contemplated in the Law. The Constitutional Court is the supreme authority of interpretation and constitutional control. In this sense, it oversees ensuring the protection of fundamental rights and guaranteeing their effective defence if they are violated. The present investigation will consist, mainly, in the analysis and review of the fundamental right to freedom of transit in the sentences issued by the Constitutional Court to determine if it guarantees the protection of constitutional rights in case these are violated. Additionally, it will be explained how to exercise the defence through the writ of restricted habeas corpus.
