Abstract: With the present research work, it is established and also emphasized, the importance that has one of our existing “Limiting Rights Penalties” currently stated in the Peruvian Penalties Code dealing with the imposition of “Community Service Penalties” to some of our law breaking citizens. This “Limiting Rights Penalties” is already about 30 years old. Its objective was to reeducate and formally reincorporate some of our law breaking citizens into society. Regrettably today, this penalties are not given the relevance they deserve in order to also help in the reduction of the overpopulation in our prisons.In the previous paragraph, constitutes the main reason for incorporating, in the first two chapters of this research work, topics involving: the origin, theories, definition and objectives of this penalties. This descriptive sequence will indeed facilitate the purpose for its incorporation in our laws and in international laws. In the subsequent chapters, analyzed indetail how these penalties are currently implemented in our penalty system. Interviews, were done to official members of the: Dirección de Medio Libre, Dirección de Política Criminal –MINJUS, a judge, a lawyer and two sentenced citizens, all of them shared their experiences, perspectives and limitations with the current implementations.

En la presente investigación se desarrolla la importancia que tiene una de las penas limitativas de derechos, contempladas en el Código Penal Peruano, la pena de prestación de servicios a la comunidad. Esta pena está cerca de cumplir 30 años de vigencia y ejecución frente a la comisión de delitos por faltas. Si bien es una medida que permite reeducar y resocializar con mayor facilidad a un sentenciado, observamos que no está teniendo la relevancia que merece, a pesar de ser una medida que permite reducir los problemas de hacinamiento en las cárceles del país. Razón, por la que se describe en los dos primeros capítulos su origen, definición, teorías y finalidad que conserva esta pena, para entender el por qué se incorporó a la normativa jurídica nacional, así como en la internacional. En los capítulos siguientes se analiza su forma de aplicación en la normativa peruana y su evaluación en la ejecución, mediante entrevistas realizadas a funcionarios de la Dirección de Medio Libre, Dirección de Política Criminal – MINJUS, juez de Paz Letrado, abogado y dos sentenciados, quienes compartieron por medio de su experiencia las perspectivas y limitaciones que tienen frente a la aplicación de este tipo de pena limitativa.
