Abstract: One of the advantages of arbitration is that the parties can appoint arbitrators to resolve their disputes, who must be and remain independent and impartial during the arbitration. In this context, the following question arises: What occurs if the arbitrators are repeatedly appointed by the same parties? In this Thesis, the standard that should be used to resolve the issue of repeat appointments of arbitrators is analyzed, presenting different standards and factors that have been applied internationally. Nowadays, in Peru, repeat appointments of arbitrators is an issue that may be being treated as a "rule of thumb", since there is no information on how this problem is resolved. This Thesis seeks to benefit arbitration practitioners by providing information on how to analyze these repeat appointments, considering distinctive features of the Peruvian arbitration system and the facts of each case. The Thesis proposes that a qualitative and non-quantitative analysis be applied to resolve the problem of repeat appointment of arbitrators, in order to determine if there are justified doubts about the independence and impartiality of arbitrators. This Thesis has considered both international and national commentaries and cases, as well as data of own elaboration regarding Peruvian arbitration practice.

Una de las ventajas que ofrece el arbitraje es que las partes pueden designar a los árbitros que resolverán sus controversias, los cuales deben ser y permanecer independientes e imparciales durante el arbitraje. En ese contexto, la pregunta que surge es: ¿Qué sucede si los árbitros son repetitivamente designados por las mismas partes? En este Trabajo se analiza cuál es el estándar que debería utilizarse para resolver el tema de las designaciones repetitivas de los árbitros, presentando los diferentes estándares y factores que han sido aplicados a nivel internacional. Hoy en día, en el Perú, las designaciones repetitivas de los árbitros son un tema que puede estar siendo analizado a "ojo de buen cubero", pues no se cuenta con información sobre cómo se resuelve este tema. Por ello, este Trabajo busca contribuir a que los operadores arbitrales cuenten con información sobre cómo analizar dichas designaciones repetitivas, teniendo en cuenta las particularidades del sistema arbitral peruano y los hechos de cada caso. Este Trabajo propone que se aplique un análisis cualitativo y no cuantitativo, para resolver el tema de las designaciones repetitivas de los árbitros, para así poder determinar si existen o no dudas justificadas sobre la independencia e imparcialidad de los árbitros. Este Trabajo ha considerado tanto doctrina como jurisprudencia internacional y nacional, así como data de elaboración propia respecto a la práctica arbitral peruana.
